99 Tohatsu and California Emissions

99 Tohatsu and California Emissions
For those familiar with CA regulations- does a 1999 Tohatsu 50 (2-stroke Carb version) meet CA standards for that year. I know it wouldn't if it were sold new, and the CARB website says it is based on year and they take ratings for an "engine family". Since I would be brininging it in from out of state and then registering not sure how they treat that. Does anyone have an existing Tohatsu 50 in CA in use? Can they be sold in CA at all? My sense is that old engines can be used if they met the standards when sold originally.

My take on the carb rules. If you have an outboard no matter what you can use it. You just cant buy a new outboard two stroke except those two that meet carb rules. tohotsu and evenrude. You can sell yours and the new owner can use it or you can buy a used one and use it even from a dealer that has a used one. Only lakes that are restricted are the ones that are used for drinking water and the lake admin. makes that call, Tahoe comes to mind, most of the lakes in calif do not have those restrictions. Your engine should be fine except in those lakes I said above.
I just went through this with the new owner of my old boat, he didnt want to buy it because he thought he would have to repower to use the boat.
I showed him the law and he called his fav. lake and they told him what I just told you.

aya16 is correct.
it's all about what's required by the manufacturer today. not about what's already out there being used (except in the case of certain lakes/waterways).
kind of like old cars vs. new cars scenerio. an old car won't pass today's emission standards, but they still let you license it based on less stringent requirements and assuming that over time there will be les of them on the road.

Thanks for the replies. That is what I thought/hoped. Ok I am drifting OT a bit hijacking my own thread, but I am moving in a few months back to Yuma, AZ and away from the Eastern NC wonderland of sailing. I am thinking I will put my boat on a trailer at Camp Pendleton and drive there on weekends to use it. If it gets too difficult and doesn't get used I may end up selling it in CA.

there are a growing number of lakes that use the water for drinking that are closeing to 2 stroke motors but this is not a state wide ban on two strokes old or new. only the sale of new engines that do not pass the new polution rules, that is two stroke or four stroke it doesnt matter. some smaller lakes that use the water for drinking and are run by county or city
munis, have closed these lakes to non polution controlled engines or restricted engine use all together. Tahoe is a major body of water but is a major source of drinking water is closed to all non complying engines.
We really need to be clear on this as some people still think because they own an older two stroke that they are banned from useing these motors anywhere in calif. This is not true and needs to be righted. There are many many places still open for the use of these motors and like what was stated above the ocean is not part of this.
One problem we will see is the absolute pressure put on folks out to have a good time by unknowing uncareing people that meen well but ruin a day for the two stroke owner with their uninformed bias and take it upon them selves to inforce a law that does not exist. With peer pressure dirty looks and outright infringement on someones family day and good time.
You Mac owners should know what Im talking about although there is no law that gives (snobs) people the teeth to do anything about the Mac we all have been greeted with the upturned nose to outright open talking loud about what a junky boat we have to make sure we hear it. Because we know our boats are legal and really dont deserve that kind of attention we normally ignore it. Imagine if you launched your boat thinking that you just might be violating a law and some joker comes over knowing (in his mind) you are and jumps all over you and your family for not being green enough. Then later you find out you were perfectly legal. By the way that guy that jumped all over you just got into a 1000hp non polution controlled elimanator spewing a tenth of his unbuned gas into the air and water. But the point here would be that 99 percent of the folks that go take their boat out with their family want to have a nice day and relax before they go back to the 9-5 grind we as responcible boat owners and users do not want to ruin someones day when we may not know what were talking about in the first place.
So please if its that important to you to help police your water world, know the law or keep it to yourself. Not gripping about anyone in particular here
just want to shed some light on some crap that goes on here in the peoples republic of Calif. where every one that can afford it buys a snob badge. And what brought this on somewhat was, as I was dinking over to the dingy dock one day in catalina a guy gave me hull as I went by about my loud stinky 1.5 hp two stroke, he pi$$ me off because I actually felt guilty till I watched his boat manner the rest of the week end. He ran an internal generator the whole weekend, his kids ran around the harbor on their new 4 stroke jet skis causing havock and his boat probably burned more gas getting there than I use in a year. Actually his BBQ BURNED MORE GAS THAN I DO IN A YEAR. I could care less about his life style and would never even give it a second thought untill he made his point about my stinky should be confiscated loud 1.5 two stroke. And I even thought about buying a nice 4stroke 4hp right at the island that day at twice the price I could get it at home.
So lets know the law and let people enjoy life as they can and think twice before we upset someone that did nothing wrong.

i launch at the O'side harbor. it's a great little marina.
however, you'll be spending alot of time on the road going back and forth (Yuma to O'side). it's about 220 miles one way.
i assume it's because you get free storeage.
if not, you might consider Chula Vista. will shave nearly 50 miles off the commute, and is probably cheaper there too.

It is pretty cheap to leave it on the trailer at Pendleton ($30)- slips are more (~$200) if I could get one. My in-laws live in O'side, and my Aunt and Uncle live in Carlsbad. I lived in Yuma for 4 years and we drove there to visit a number of times- it isn't a bad drive unless we hit traffic on 5 or 15!, We would be staying in O'side hills area in any case- not terribly far from Camp Pendleton. I lived in Oceanside for 4 years when my Dad was stationed on Camp Pendleton as I was growing up(late 70's early 80's) . I am familiar with the Oceanside boat ramp- I launched a jet ski (yes- I know...younger days) there a few times. Long, steep ramp and slippery if I recall correctly. How is the cruising once you get past the jetty? If I remember correctly the O'side harbor and the Camp Pendleton Marina flow out to the ocean past the same jetty. How is the ocean out there in terms of swells (average) and sailing the Mac in those waters?
Aya-- I totally agree--some people are downright ridiculous hypocrits when it comes to enforcing things about which they know nothing. I thought that the new 2-strokes met the CARB regs for 2006 and some through 2008. Is it true that lakes are banning 2 strokes as a whole or just engines that don't meet the regulations?
